1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and PM Interview Tutor ("Company", "we", "us", or "our"), a service operated under Estonian law, governing your access to and use of our interview preparation platform.

By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Service Description

PM Interview Tutor provides an AI-powered interview practice platform designed to help users prepare for product management interviews. The Service includes but is not limited to:

• Simulated interview sessions with AI interviewers
• Automated feedback and performance analysis
• Interview history tracking
• Access to various company-specific interview scenarios

The Service is provided on an "as-is" and "as-available" basis for educational and practice purposes only.

3. User Obligations and Acceptable Use

By using our Service, you agree to:

• Provide accurate and complete registration information
• Maintain the security and confidentiality of your account credentials
• Use the Service only for lawful purposes and in accordance with these Terms
• Not attempt to gain unauthorized access to any part of the Service
• Not use the Service to harm, harass, or impersonate others
• Not reverse engineer, decompile, or attempt to extract source code from the Service

4. Payment Terms and Credits

Access to interview sessions requires the purchase of credits or a subscription plan. All payments are processed through Stripe and are subject to their terms and conditions.

Credits and Refunds:

• Credits are consumed when you complete an interview session
• All sales are final. No refunds will be provided for purchased credits or subscriptions
• Credits do not expire unless otherwise specified
• Subscription plans renew automatically until canceled

5. Disclaimer Regarding Interview Performance

You acknowledge and agree that:

• No Guarantees: Practice sessions on our platform do not guarantee success in actual job interviews
• AI Limitations: Our AI-powered feedback is automated and may contain inaccuracies, biases, or limitations
• Practice Tool Only: The Service is a practice tool and does not replace professional career coaching or interview preparation services
• No Liability for Failed Interviews: The Company accepts no responsibility or liability for unsuccessful interview attempts, job rejections, or any negative career outcomes that may occur following use of the Service
• User Responsibility: You are solely responsible for your interview preparation, career decisions, and interview performance

6. Data Security and Privacy Disclaimer

You acknowledge and agree that:

• No Absolute Security: While we implement reasonable security measures, no system is completely secure and data breaches may occur
• Third-Party Services: We use third-party services (including but not limited to Supabase, OpenAI, and Stripe) and are not responsible for their security practices or data handling
• Data Transmission Risks: You transmit data at your own risk and accept that unauthorized access, data loss, or data corruption may occur
• Limited Liability: The Company shall not be held liable for any data breaches, unauthorized access, data loss, identity theft, or any damages arising from security incidents
• User Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account
• No Compensation: In the event of a data breach or security incident, the Company's liability is limited to providing notice as required by applicable law, and no compensation or damages will be provided

7. Intellectual Property Rights

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are the exclusive property of the Company or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without prior written consent.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or business opportunities
• Any damages arising from failed interviews or career-related outcomes
• Any damages arising from data breaches, unauthorized access, or security incidents
• Any damages arising from service interruptions, errors, or technical issues
• Any damages arising from reliance on information or feedback provided by the Service
• Any damages exceeding the amount paid by you to the Company in the 12 months preceding the claim

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any claim that your use of the Service caused damage to a third party.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia.

11. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.

12. Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

Upon termination, your right to use the Service will immediately cease. No refunds will be provided for any remaining credits or subscription periods.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last Updated" date.

Your continued use of the Service following the posting of changes constitutes acceptance of those changes.
